The Department of Commerce’s preliminary findings were released last week (October 1, 2024) on the Alliance for American Solar Manufacturing trade petition’s Countervailing Duties (CVD) filing. Since that announcement, a significant calculation error was discovered in the solar Malaysia preliminary results, which understates Jinko Solar’s preliminary duty margin by about 10 percentage points. “As we emphasized last week when the preliminary findings were released, there remains a significant amount of data for the Commerce staff to uncover, including new alleged subsidies that require further investigation, and the respondents have yet to address Commerce’s inquiries. All of this will lead to tariff rates continuing to increase.” – Tim Brightbill, the attorney representing the Alliance, has filed a ministerial error allegation with Commerce; the public version available upon request.
